Cancellation policy

1.1 Buckhead Auto Rentals LLC (referred to as “Buckhead Auto Rentals,” “we,” or “us”) offers a subscription program (“Service”) providing access to premium vehicle rentals and chauffeur services across various cities, including but not limited to Atlanta (GA), Los Angeles (CA), New York City (NYC), Miami (FL), and Chicago (IL).

1.2 Monthly Subscription Fee: $899/month, subject to any applicable taxes.

1.3 Subscription Discount Benefits: This subscription provides up to a 50% discount on each rental, including chauffeur services, with specific discounts varying by vehicle type and service. Not all vehicles or services may qualify for the full 50% discount, as rates differ depending on the rental or service selected.

2.1 By subscribing to or using our Service, you agree to these Terms and any modifications we may make. Additional terms may apply to special promotions, which will control if there is a conflict with these Terms.

2.2 Content and Availability: Buckhead Auto Rentals reserves the right to modify vehicle and chauffeur service availability based on city-specific demand, operational needs, and other factors.

3.1 Free trials, if offered, are subject to specific terms provided at sign-up. Unless canceled before the trial period expires, the subscription fee will be automatically billed to your Payment Method.

4.1 Authorized Payment Methods: We accept credit and debit cards and other approved payment methods. You represent that you have the authority to use the provided payment method.

4.2 Billing and Payments: Subscription fees will be charged to your selected payment method on the subscription date. You authorize us to store your payment method and to automatically bill your account each month until canceled.

4.3 Price Adjustments: Buckhead Auto Rentals reserves the right to change subscription fees. Notice of such changes will be provided at least 30 days before implementation.

4.4 Payment Default: Failure to make timely payments will result in suspension or termination of Service. Buckhead Auto Rentals reserves the right to pursue outstanding amounts owed.

5.1 Term and Renewal: Subscriptions automatically renew each month unless canceled in accordance with these Terms.

5.2 Cancellation by Subscriber: Subscribers may cancel at any time by logging into their account and following the cancellation instructions. Cancellation becomes effective at the end of the current billing period.

5.3 Early Termination: If you terminate the subscription before the end of a billing period, or if we terminate for cause due to a breach of these Terms, no portion of the subscription fee will be refunded.

6.1 Subscribers must be at least 18 years old or the age of majority in their jurisdiction to subscribe to and use the Service.

7.1 Maximum Liability: Our liability to you for damages arising from your use of the Service is limited to the total amount you paid in subscription fees in the twelve (12) months preceding the claim. We are not liable for indirect or consequential damages.

8.1 Dispute Resolution: Any disputes arising from or related to these Terms, including their interpretation and enforceability, will be resolved through binding arbitration in accordance with the terms below. You and Buckhead Auto Rentals agree to waive the right to a trial by jury.

8.2 Class Action Waiver: You and Buckhead Auto Rentals agree that all claims will be resolved on an individual basis. You may not bring a claim as a plaintiff or class member in a collective, consolidated, or representative action.

9.1 These Terms shall be governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

10.1 Arbitration Requirement: Any claim or dispute arising out of or relating to these Terms, your subscription, or your use of the Service will be resolved exclusively through binding arbitration administered by the National Arbitration and Mediation (NAM) in accordance with its rules. Arbitration proceedings will be conducted remotely by telephone or video, unless both parties agree to an in-person hearing.

10.2 Severability: If any portion of this Arbitration Agreement is deemed unenforceable, the remaining provisions shall remain enforceable.

10.3 Opt-Out Option: You may opt out of this Arbitration Agreement by notifying Buckhead Auto Rentals in writing within 30 days of subscribing. Opt-out requests must be sent to [contact information].

10.4 Confidentiality: All arbitration proceedings and information disclosed in the course of arbitration shall be treated as confidential.

11.1 Refunds: All payments are non-refundable. If you cancel or if your subscription is terminated for cause, you will not be entitled to a refund for any unused portion of the subscription.
